MINUTES OF THE RIGHTS OF WAY COMMITTEE OF ST MEWAN PARISH COUNCIL HELD ON 

MONDAY 7th NOVEMBER 2011 AT 2.00 PM IN TREWOON VILLAGE HALL

 

PRESENT:    Cllr Mrs J M Padley, A C Wynn, A M Barnes, J B Blake, Mrs P M Mitchell.

 

In Attendance:   L C Budge Clerk to the Council, Mrs H J Tucker Clerical Assistant.

 

Apologies:       There were no apologies.

 

Election of Chairman:            In the absence of Cllr Mrs Old, Cllr Mrs J M Padley agreed to chair the meeting.

 

Declarations of Interest:       There were no declarations of interest.

 

Minutes of the last meeting:             A review of the meeting held on 12th September was carried out.

 

Matters Arising:-       Following concerns regarding concrete being place at the beginning of Paramor Lane a walk had been arranged to inspect it.  These concerns proved unfounded and it was felt that it had improved the beginning of the lane.

 

Footpath Signposting:-           A thorough review of the reports received and queries raised on the footpath signage was carried out.  It was resolved that the clerk will now draw up a list of action for replacement signs and refer this to Cornwall Council. This will also be distributed to Councillors on the committee. 

 

Urgent business:-       Cllr Blake advised that there has been a book published by the Ramblers Association on St Austell walks and that a walk in St Mewan Parish featured in it. These can be obtained from Cllr Blake at £2 each per copy.  It was noted that the path between Trewoon Village Hall and Burngullow is shown on the map as a road and therefore doesn’t need to be claimed as a footpath.  It was agreed to put a sign at the junction with the road showing the footpath.  Councillors raised concern that the area between the kissing gates on the Burngullow footpath was overgrown, and also regarding the barbed wire on the top of the fence.  It was agreed the clerk would write to Chris Varcoe and raise this with him.  The Clerk advised he had written to the occupier of Polyear Farm but to date no response had been received.  It was resolved to write to him again and advise that if no response was received the parish council would continue to maintain the footpath as before.  The footpath between Trevanion Road and Cooperage Road is in need of repair. It was agreed to obtain quotes to re-tarmac, remove unwanted posts and remove the rusty barbed wire.  It was resolved to write to Mr J Tucker and request that the footpath through his field from Footpath 6 be maintained at the minimum legal width.

 

The clerk advised that although some footpaths may be claimed, they may not show on the map held.  It was resolved to contact County Council and request the latest up to date map.

 

The clerk read out a letter from Imerys advising that the Blackpool Dryers site was going to have a gate put at the entrance, however this would not affect the footpath.

 

The clerk read out a letter from BTVC regarding footpath maintenance.  It was mentioned that the Ramblers Association also have a voluntary group called React to carry out this type of work.

PRESENT:   Cllrs Mrs HV Old (Chairman), Cllr Mrs JM Padley, AC Wynn, AM Barnes, J B Blake, Cllr Mrs J A Ringrose and Cllr Mrs PM Mitchell (deputising for Cllrs C Passmore and Mrs J E Hamley).

Election of Chairman:            Cllr Mrs H Old accepted the post of chairman that had been proposed and agreed at the previous meeting.

 

Declarations of Interest:-      There were no declarations of interest.

 

Minutes of the last meeting:-            Minutes of the last meeting were read and agreed to be a true record at the full council meeting on 20th July 2011. (Prop Cllr Mrs Mitchell,  2nd Cllr Mrs Padley)

 

Footpath Signposting:-           The Clerk will complete the list of Footpaths that need signposting. 

 

The Parish Footpath list now totalled 47 paths.  The 3 in Sticker have had the County Council Notices up for some time but no confirmation has been received.  These have been followed up with County Staff who are still dealing with them, but they expect this to be satisfactorily concluded soon.  The path from the area by Polgooth Inn to join the Bal East Lane path has to be claimed.  The path from Trewoon Playing field, to Blackpool (Methrose Farm) should also be claimed as a footpath. The spur to Lower Tye from footpath 23/1 is now overgrown completely. This should be claimed and cleared. 

 

Footpath maintenance Path 419/15/2:            The clerk explained that the maintenance worker had been stopped clearing this footpath by the owner/occupier of Polyear Barn because of alleged damage caused during a previous year’s clearance to a boat. Following this the clerk had met the new owner (with the owner of CHMS whose worker was clearing the path), and after discussion the owner of Polyear Barn agreed that he would accept responsibility for the upkeep of the lane from his gate to where it meets Coliza Hill. The clerk will write and confirm this agreement with the new owner of the property.

 

Paramore Lane:         Information had been received from the RSPCA that following the disturbance to the land adjoining this lane they had taken action to bring a prosecution against the land owner because of the disturbance to the badger sett.  After their solicitors had received a copy of the environmental statement that had been commissioned by the land owner they had decided to no longer pursue this action.

 

Urgent business:-       Cllr Blake advised he had been contacted by Mrs Best who was concerned that some tarmac had been laid on the footpath alongside her property.  It was resolved to have a look at this when doing an organised walk on Friday 16th September at 2pm.  Cllr Mrs Padley has been advised that the Scout Group are going to pursue the possibility of putting a post in Green Lane with Hamish Gordon.   

 

Concern was expressed about the state of the permissive footpath through to Polgooth Mine.  The clerk agreed to speak to Mr May who is responsible for this.

Election of Chairman:          It was resolved to ask Cllr Mrs H Old if she would accept the post of chairman. However Cllr Mrs Padley agreed to chair this meeting.

Minutes of the last Meeting        The minutes were read out and agreed to be a true record.  (Prop Cllr AM Barnes, Sec Cllr A Wynn.)

 

Footpath to Polgooth Inn:    It was resolved to claim this footpath.(Prop Cllr A Wynn, Sec Cllr Mrs JE Hamley). Members raised concern about the amount of cutting back of hedgerows in this area.  It was resolved to write to the Cornwall Council and obtain a copy of the Tree Preservation Order.

 

Footpath at Paramor:           The footpath is still defined, but it was agreed we write to Mr May to ascertain who authorised the severe cut back in this area.

 

Footpath Signage:     It was resolved that the clerk would examine the reports of Councillors and summarise the findings.  It was agreed this may take some time. 

 

Planned footpath walk:.  As it is difficult to get a date where everyone can meet for walks it was agreed that Councillors will inspect their respective village areas.  The Clerk agreed to draft a form and distribute them to Councillors so reports can be made on these walks.

 

Urgent business:         The footpath from the exit at Hembal Lane past the Trewoon Village Hall to the top of the playing field has not been claimed. It was agreed this should been claimed as a bridleway or byway. Concern was expressed that if the footpath going down the side of the old Blackpool field is not cut if may disappear.

 

It is getting increasingly difficult to get hold of anyone from Cornwall Council by telephone to discuss claims for footpaths. Paths that need to be claimed are Lower Glenleigh and Tye Lane.

 

The Clerk will investigate the footpath from Chapel Hill past the Polgooth Chapel. 

 

Imerys have put boulders on the road alongside Blackpool Pit and this means that vehicles cannot get beyond this point.  After looking at the map it appears that this is a public road which means these boulders should be removed.  It was resolved to contact Adrian Mutton and ask him to look into this.

Minutes of a meeting of the Rights of Way Committee of St. Mewan Parish Council held at Trewoon Village Hall on Monday 22nd November 2010 at 2.00 p.m.

 

Present: Cllrs. Mrs J M Padley, H V Old, A M Barnes and A C Wynn. No public.

In attendance: Mr L C Budge, Clerk.

Apologies: Cllrs W J Lobb, J B Blake, Mrs J E Hamley and Miss A Lake. The clerk apologised for the fact that members had not received a reminder notice of this meeting, which had been arranged at the meeting held on 25th October.

Declarations of Interest: None

Storm Damage to Paths: The recent storms had caused damage to some paths. Bridleway 6 leading from the A390 to Polgooth had received damage to the surface in the area after leaving the field at the top to the part of the lane where it met the spur to Trelowth Road. The Chairman of the council and the clerk had met an owner of a property which adjoined this part of the path and had arranged for urgent repairs by machine to be carried out to the surface in that area with material that had been washed out, and the ditch that ran alongside to be cleared. The spur from 38/1 to the pub (unclaimed) was badly washed out and had very deep ruts, as did parts of Higher Coombe Lane (41/1). We had kept in touch with Cornwall Council on flood damage but it was agreed that we would write to them and report these defects. It was agreed that we needed to walk FP 4 because there were problems traversing private land at one point. Members voiced concern about some well-used paths that are not shown on the definitive map, and it was agreed to check the position on the path from the Trewoon Village Hall to where it met footpath 30/1, and other claims for paths from 23/1 to Lower Tye and the path from Trewoon to Gover. It was agreed to investigate the use of a hand machine to level the footpath to Burngullow (30/1) because the surface was rutted. It was also agreed that we should write to Cornwall Council for an explanation as to why they are prepared to accept fencing on public footpaths with the barbed wire at the top on the public side of the path and not the other side as recommended (various places quoted –FP 30/1, 27/1 and the public road leading to 29/1 and 40/1) and why large stones have been permitted to be placed by Imerys on the public road leading to footpaths 40/1 and 29/1. It was reported that the fencing adjoining the railway on footpath 25/2 requires attention and the other side also needs cutting back. Two posts at the entrance from Westbridge Road require removal and the tarmac (which Parish Council originally provided) needs attention. We have advised British Rail about the condition of the fence before but have not yet received any action. It was noted that on Footpath 7/1 Paramor Chapel to Chapel Hill Sticker brambles required removal. Cornwall Council should be advised that a path outside our Parish 422/06/2 used on circular walks requires attention.

Footpath Signage. There is no sign at the bottom of Higher Coombe Lane (41/1) The footpath 25/1 from the bridge at Cooperage Road to Trevanion Road, Trewoon, requires signing at either end. The footpath to Gover requires signing at either end. The sign to Footpath 30/1 has been uprooted. Only one sign for two paths at entrance to 29/1 and 40/1. No sign at bottom of Retanning Lane Sticker (FP 8). FP11, the sign to football field is unreadable. The bridleway from St. Stephen Road to Hewaswater 34 /1 and 2 require signs at either end. The footpath from Modus Lane to link up with Little Lane (35/2) requires signing. Permissive path past South Polgooth Mine needs signing from Sticker to Five Turnings road. Footpath 14/1 needs signs changing from footpaths to Bridleways at both ends. FP 04/1 needs signing at either end. Sign needed at Bridleway 6 by lay by at Trelowth.

Planned Footpath walks: It was agreed that the next Footpath walk would meet at the lay by off the road crossing the new bridge over the A390 at Trelowth at10.00 a.m. on the 15th January 2011 and walk from FP 18/1 past Nanphysick and return via 12/1 past Tregandanel to Trelowth. Cllr Barnes advised of a walk leaving Polgooth on New Years Day – since confirmed as 11.00 a.m. – with sandwiches and tea/coffee available at the Village Hall afterwards.

Minutes of a meetingof the Rights of Way Committee of St. Mewan Parish Council Village Hall held at Trewoon on Monday 25th October 2010 at 2.00 p.m.

 

Present: Cllrs. Mrs J M Padley, H V Old, A M Barnes, R T Best and A C Wynn. No public.

In attendance: Mr L C Budge, Clerk. Mrs H J Tucker, Clerical assistant.

Apologies: Cllrs W J Lobb, J B Blake, Mrs J E Hamley and Miss A Lake.

Election of Chairman: Cllr. Mrs J M Padley was re-elected Chairman for the ensuing year. (Prop: Cllr Mrs Old, Sec: Cllr Barnes)

Declarations of Interest: None

Footpath Signage. All signs were brought up to date some years ago but many were now in need of replacement or updating. It was agreed that it would be necessary to carry out a full survey of signage to ensure that all were correct. It was then agreed that Cllr Mrs Old would do the survey for Polgooth, Cllr Mrs Padley for Sticker area and Cllrs Wynn/ Blake for Trewoon area. The clerk would also assist with Trewoon and other areas if required.

Ditches by Footpaths: Responsibility for ditches was queried and it was explained that minor rivers are the responsibility of Cornwall Council, although we had always in the past carried out the clearing of the ditch at the top of Tye Shute Lane. Cllr. Mrs Old agreed to check on the garage draining onto the lane here.

Footpath fencing. Recent fencing by Imerys had barbed wire on top of the fencing. The clerk advised that he had pointed this out to Hamish Gordon on the Burngullow footpath as well and he had agreed to take this up but no action had been taken as yet.

Footpath Maps: It was agreed that the Definitive Map file would be brought to the next meeting to ensure that Path Numbers and routes were correct on the large Footpath Maps.

Planned Footpath walks: It was agreed to defer this and prepare a schedule of walks at the next meeting after the surveys were completed.

Urgent Business: The route of Footpath 4 at Polgooth requires to be clarified and the claim for footpath/bridleway off of Porth Hall House, Sticker. Claim should also be made for the spur to Tye from the By-Way.

Next Meeting: This will be held at Trewoon Village Hall on Monday 22nd November 2010. at 2.00p.m.
